These Terms govern access to pictag.ai, operated by pictag.ai. By creating an account, purchasing credits or using Pictag, you agree to these Terms.
1. Eligibility
You must be at least 18 and legally capable of accepting these Terms. If you use Pictag for an organisation, you confirm that you have authority to bind that organisation.
2. The service
Pictag provides AI-assisted tools that may include Manual and Smart image tagging, metadata editing, image analysis, AI upscaling, AI chat, multilingual Read Aloud, image generation through connected providers, projects, search, export tools, synchronisation, free functions and universal prepaid Pictag Credits. Features, providers, models and limits may change as the product and external services evolve.
3. Accounts
You are responsible for accurate account information, control of your sign-in method, connected provider accounts, important exports and activity performed through your account unless caused by our breach. Notify us promptly if you suspect unauthorised use. You may not share, sell or automate account access in a way that bypasses service limits or security controls.
4. Free functions and prepaid credits
Pictag provides the free functions and limits shown in the application. Manual Tagging currently supports batches of up to 2,000 images and uses 0 Pictag Credits, including for accounts that also hold paid credits. Smart Metadata may accept up to 2,000 selected images in a batch, but paid AI analysis is limited by the available credit balance. Supported paid AI actions use the same universal Pictag Credit balance. Fixed-cost actions show their cost before use, while variable text requests are charged according to the current model-aware credit schedule and report the charge after completion. Purchased credits do not expire, have no cash value, cannot be transferred between accounts and are removed when the account is deleted. Failed paid AI actions are automatically refunded when the service records the failure.
5. One-time purchases, taxes and refunds
Credit packs are one-time purchases processed by Stripe at the price shown during checkout. Taxes may apply. Fully unused purchases may be refunded where permitted or required by law and subject to the checkout terms. Once credits from a pack have been consumed, refund eligibility may be reduced or unavailable except where mandatory law requires otherwise. Credit packs are not subscriptions and do not renew automatically. Questions may be sent to support@pictag.ai.
6. Connected providers and provider charges
When you connect a third-party provider credential, you authorise Pictag to store it encrypted, use it for requests you initiate, receive connection metadata and enforce Pictag service limits. You remain responsible for provider charges, budgets, model restrictions, expiry, provider terms and revocation. BYOK provider charges remain the user's responsibility and consume zero Pictag Credits. When the user explicitly chooses Pictag Credits for a supported provider-funded action, Pictag pays the upstream provider and deducts the displayed credit cost.
7. Third-party services
Pictag relies on services such as hosting providers, Google, Stripe, Pollinations, email services and other AI providers. Their availability, prices, models, policies, filters and account decisions are outside Pictag’s control. We may disable an integration that becomes insecure, unlawful, unavailable or incompatible.
8. User content
User Content includes prompts, images, files, metadata, code and other material you submit. You retain rights you hold in that content and grant Pictag the limited permission needed to host, transmit, process and display it for the requested service, security and support. You confirm that you have the rights and permissions needed to submit it.
9. AI-generated content
AI output may be inaccurate, incomplete, biased, unexpected, non-unique or unsuitable. Pictag does not guarantee factual accuracy, originality, non-infringement, marketplace acceptance or copyright eligibility. You are responsible for review, rights clearance, destination-marketplace requirements and any disclosures or provenance obligations that apply to AI-generated or materially AI-altered content.
10. Acceptable use
You may not use Pictag to break law, violate rights, submit content without permission, obtain credentials or private data, bypass quotas or billing, operate unauthorised bots or scraping, distribute malware, facilitate fraud, interfere with the service, use another person’s provider account without permission or generate content prohibited by applicable provider rules.
11. Synchronisation, local storage and assets
Signed-in accounts may synchronise supported chat text, projects and preferences. Synchronisation can be delayed or unable to preserve every conflicting edit. Original uploads, generated image binaries and attachments are not included in account sync by default. Pictag does not currently provide permanent cloud asset storage; download and back up assets you need to keep.
12. Quotas and fair use
Limits may include daily or monthly quotas, model lists, batch/file limits, queue or concurrency limits and anti-abuse controls. A displayed 2,000-image batch limit is a maximum accepted batch size, not a promise that 2,000 AI or upscaling operations will run simultaneously. Requests may fail because of provider balance, provider restrictions, Pictag limits, moderation, rate limiting or technical issues. Provider billing rules are controlled by the provider.
13. Intellectual property
Pictag’s interface, software, branding, documentation and original content are owned by us or our licensors and protected by applicable law. These Terms do not transfer ownership of Pictag. You may not copy, resell, reverse engineer or redistribute the service except where permitted by law or an applicable licence.
14. Suspension, sign-out and termination
You may stop using the service, sign out, disconnect a provider, clear synchronised data or request account deletion. We may restrict or terminate access for material or repeated violations, fraud, abuse, security risk, non-payment, legal requirements or discontinuation. Scheduling account deletion revokes active sessions and begins a seven-day recovery period. Signing in during that period cancels the request. When deletion is finalized, active account data and saved provider credentials are removed and unused credits are removed, subject to records that must legally be retained.
15. Availability and disclaimers
Pictag is provided on an “as available” basis. To the extent permitted by law, we do not guarantee uninterrupted operation, permanent availability of a model, error-free output, permanent storage or fitness for a particular purpose. Mandatory consumer guarantees remain unaffected.
16. Limitation of liability
To the maximum extent permitted by law, Pictag is not liable for indirect or consequential loss, lost profits, lost data, provider charges, unavailable third-party services or decisions made in reliance on AI output. Total liability arising from a paid service will not exceed the amount paid to Pictag during the 12 months preceding the event giving rise to the claim, unless applicable law requires otherwise.
17. Privacy
The Privacy Policy explains how personal data is processed. Data needed to perform a request may be transmitted to the selected or fallback third-party provider.
18. Changes
We may update these Terms to reflect product, provider or legal changes. Material changes affecting purchased credits will be communicated where required.
19. Governing law and disputes
These Terms are governed by the laws of Greece, without removing mandatory consumer rights or jurisdiction available under applicable law.
